Barriers to competition and free market access are structural characteristics of the market or actions of economic agents that prevent market access to competitors or limit their ability to compete in a given market, as well as legal provisions which unduly impede or distort the process of competition and free market access.
To determine an essential facility, the authority takes into consideration whether the facility is controlled by one or more economic agent with substantial market power; whether the facility cannot be reproduced from a technical, legal, or economic point of view; if is indispensable for the provision of goods or services in one or more markets, and has no close substitutes, among other criteria.
The procedure for barriers to competition or essential facilities aims to issue recommendations to the authorities or establish guidelines or regulation to prevent barriers or essential inputs from affecting or distorting free competition and economic competition. It is not intended to impose fines or other sanctions on economic agents.
