The firm advises and presents consultations on economic competition issues that require guidance or resolution by the authorities responsible for applying the Federal Law on Economic Competition.
Transactions between economic agents are increasingly complex and with effects on multiple markets, so on some occasions the opinion of the authority is required to give legal certainty to economic agents. Therefore, we file consultations, either for the authority to guide individuals or to issue a formal opinion.
The Federal Commission for Economic Competition provides general guidance in relation to the application of the Federal Law on Economic Competition, but it also issues formal opinions, i.e., it issues a binding criterion for the authority itself, when novel questions are raised, or when there is no precedent, it is a relevant question and that the competition authority consider that this is a matter that needs to be resolved.
